Conditions and types of activity

To obtain a work permit, the employer must consider two important aspects: it is granted for a specific person, as well as for a specific position in the respective company. Changing the employer requires obtaining a new permit.

There are also a number of conditions that the employer must meet in order to receive the employment notice. These general conditions concern: payment of tax obligations for the last quarter before submitting the application, the absence of convictions for various crimes or other recent sanctions applied to the employer, as well as the performance of an activity consistent with the position for which the foreigner is being employed. There are also a number of special conditions, which change depending on the type of activity concerned.

1. Permanent activity

Employment certificate The employment of permanent workers is based on an individual employment contract concluded for a fixed or indefinite period. It is essential that the employee meets the necessary conditions for the position. There is also a relaxation of the conditions regarding two categories of employees: professional athletes and company administrators.

2. Internship activity

This type of activity requires the granting of an approval only for legal entities and the conclusion of a contract for a specific period. The purpose of the employment must concern the completion of an internship for professional training. Also, trainee must hold a higher education diploma.

3. Seasonal work and au pair

Seasonal activities must be clearly defined and carried out for a limited period of time, depending on the sequence of the seasons. Also, foreigners employed in these positions must have the necessary qualifications to carry out the respective activities in Romania.

Au pairs involve their employment by a host family, for a fixed period of up to one year and for certain light household or childcare activities.

4. Cross-border activity

The regulations for cross-border workers allow the employment of citizens from Romania's neighboring countries, who live in border areas in Romania. These employments are carried out through full-time employment contracts, either for a fixed or indefinite period, and in the case of certain citizens (from Moldova, Ukraine and Serbia), an employment permit is not required, provided that certain legal requirements are met.

5. Highly skilled workers

The work permit for highly qualified workers aims to facilitate the employment of foreigners in specialized positions that require a high level of qualification and expertise. The imposed conditions, such as the requirement of a salary above the national average and verification of professional training, ensure that the jobs are filled by trained individuals, as provided for in the legislation regulating the respective professions.
